SMBs under labour standards

No decree to follow. Just a statute, the CNESST, and employees who want to be paid right.

Restaurants, retail, warehouses, workshops, services: with no parity committee to answer to, the Act respecting labour standards still applies, and you are the one who has to be able to demonstrate it. Clic Horaire applies the standard week, overtime, holidays and indemnities from the punch onward, then prepares your pre-payroll.

What it costs you today

“We don't have a decree” doesn't mean “we don't have obligations”.

This is the sector where risk is worst estimated: with no parity committee to restate the rules every month, errors accumulate silently, until a complaint, an audit or a badly settled departure.

Overtime worked out in someone's head

Beyond 40 hours, the 50% premium is owed. When hours are approximate, so is the premium: and the error repeats on every pay.

Holidays paid by feel

A statutory holiday indemnity is calculated on the preceding four weeks, not on a normal day. Few SMBs get it right, and nobody notices until a complaint.

A time register that doesn't really exist

Schedules in a spreadsheet, hours in a notebook, changes by text. The day you must prove what an employee worked eight months ago, there's nothing to produce.

Schedules redone three times a week

A last-minute call-in, a replacement, a no-show: with no tool, every change is replayed on the phone and lost before payroll.

An SMB with no decree doesn't have fewer obligations. It simply has fewer people to handle them: which is exactly the problem software should solve.

What we do for you

The law applied without you knowing it by heart.

You don't have to remember which section holds the averaging rule or how a holiday indemnity is computed. You schedule, your employees punch, and the engine applies what the law provides.

Three warehouse employees in uniform standing between the storage racks.
Warehousing and logistics: shifts get punched, hours get counted.
Two craftsmen in a woodworking shop reviewing plans together.
Workshops and manufacturers: premiums follow the actual hour.
Three restaurant staff members in uniform standing in front of the entrance.
Food service and retail: holidays and tips don't wait.

Standard week and overtime, applied on their own

Beyond 40 hours in the week, the 50% premium is calculated at the end of the shift. The maths no longer depends on who ran pre-payroll that week.

The eight Québec statutory holidays

The calendar is built in and the indemnity is computed the way the law provides, over the reference period: not by feel, and not on a typical day.

Vacation and paid absences

Annual vacation indemnity of 4% or 6% depending on continuous service, and the first two days of absence for illness or family obligations, tracked employee by employee.

Hour averaging, kept within bounds

If you average hours across several weeks, the engine applies the mean over the agreed period and flags you when an arrangement would exceed what the law allows.

A real register, kept and timestamped

Every hour worked, every schedule change, every correction: recorded with its author and its moment. It's your evidence, and it builds itself.

Schedules employees see on their phone

Publication, change, replacement: the employee is notified and confirms. Fewer Sunday-evening calls, and a record of who accepted what.

Time-off requests land in the right place

Vacation, sick, personal or unpaid leave: the employee files from the app, with their balance shown beside the request. You approve, the absence is written to the schedule and the covered shifts disappear. Swaps between employees follow the same path, with or without your sign-off depending on how you set it.

A typical week

A working week, simplified pre-payroll

A retailer with 18 employees, variable shifts, two managers who also do other things. Here is the week inside the software.

  1. Mon

    The schedule is published

Each employee gets it on their phone and confirms. Nobody can say they didn't know.

  2. Tue

    An employee calls in sick

The replacement happens in the schedule; the first two paid days the law provides are tracked automatically for that employee.

  3. Thu

A big day, three extra hours

The week goes past 40 hours: the 50% premium applies to the excess hours, with nobody calculating it.

  4. Fri

A statutory holiday falls in the period

The indemnity is computed over the reference period the law provides, for every employee: including those on variable schedules.

  5. Payroll

    The export goes out

Qualified hours (regular, premium, holidays, absences) are sent to your payroll software. Nobody retypes anything.

A retail employee smiles while tapping the shop's point-of-sale terminal.

No spreadsheet was opened, and if the CNESST asked for the last eight months of records, they'd already be there.

CNESST

The regulatory side

What the Act respecting labour standards requires of you

These rules apply to almost every Québec business not covered by a decree or an agreement. They don't depend on your size or your sector.

40-hour standard work week

Beyond the standard work week, hours carry a premium of 50% of the employee's usual hourly wage.

Eight paid statutory holidays

The Québec calendar provides eight paid statutory holidays, and the indemnity is computed on the pay weeks preceding the holiday rather than on a normal day.

Vacation and paid absences

Annual vacation indemnity rises from 4% to 6% with continuous service, and the first days of absence for illness or family obligations are paid after a certain length of service.

Register and pay statement

The employer must keep a system recording hours and hand out a detailed pay statement. Without a reliable register, it's the employee's version that carries the weight.

Frequently asked

What SMBs without a decree ask us first

The questions that come up in almost every demo, with the short answer.

We have no decree and no union. Is Clic Horaire meant for us?

Yes. By default the engine applies the framework of the Act respecting labour standards: standard week, overtime, holidays, vacation indemnity. You can then layer your own policies on top (evening premiums, more generous overtime, time banks) above the statute, never below it.

Our employees have very variable schedules. Does the holiday calculation follow?

Yes, and that's exactly where manual errors are most frequent. The indemnity is computed over the reference period the law provides rather than on a typical day, which gives the right amount even for a part-time employee whose weeks never look alike.

Are we required to keep a record of hours?

The employer must have a reliable recording system and hand out a detailed pay statement. With hours written by hand, the evidence is weak in a disagreement; with a timestamped punch and an audit trail, it's solid on both sides.

Can hours be averaged over more than one week?

The law allows averaging within a specific framework, with the employee's agreement and a maximum duration. The engine applies the mean over the agreed period and flags situations that would fall outside what the law permits.

What if our sector later becomes covered by a decree?

You change framework without changing tool or history. It's the same engine that applies the CPEEP decrees and the CCQ agreements: enabling a decree means loading its rules on top of your existing data.

What does it cost for a small team?

Pricing follows the number of users active in the month: a team of ten doesn't pay for a structure of a hundred. The simulator on the Pricing page gives the exact amount before any conversation.
